If Customer terminates the Services provided under this Service Order Form that is an On-Net Location (as defined below) prior to the end of the Term (whether prior to or after installation of the Services), Customer will pay Rogers Business upon demand, in one lump sum, as a genuine pre-estimate of liquidated damages, an amount equal to 50% of the monthly recurring charge set out in the Service Charges and Term table, for the number of months remaining in the Term. “On-Net Location” means any location where Rogers Business owns local access circuits which are directly connected to the Rogers Business Backbone Network. If Customer terminates a Service provided under this Service Order Form that is an Off-Net Location (as defined below) prior to the end of the Term (whether prior to or after installation of the Services), Customer will pay Rogers Business upon demand, in one lump sum, as genuine pre-estimate of liquidated damages, an amount equal to 100% of the monthly recurring charge set out in the Service Charges and Term table, for the number of months remaining in the Term. “Off-Net Location” means any location where Rogers Business uses a third-party carrier to provide local access circuits to the Rogers Business Backbone Network or where Rogers Business is required to do a build to the location.
